Abstract
The nature of the oil and gas industry makes the conclusion of international contracts inevitable. importance of upstream oil and gas contracts in Iran from one perspective, and the necessity of observing the principles of the Islamic economy in these contracts from another perspective, led us to examine these contracts. From there, the issue took on economic, political, and social dimensions. In the next stage, new issues and aspects of these contracts were explored. The methods of establishing an Islamic economy were studied, and the viewpoints of Islamic scholars regarding the conclusion of these contracts were examined. As a result, it was concluded that the type of contract alone cannot be a proper standard for determining whether it complies with Islamic principles or not. Furthermore, in addition to general considerations, specific minimum standards at various levels must be observed in each contract, regardless of its type, in order for it to be deemed in accordance with Islamic principles.
